Open Carry On Motorcycle
A motorcycle is not defined by MS as a Motor Vehicle.
Open carry on motorcycle. The law seems to be rather silly that one is allowed to open carry while in a vehicle but once you are a pedestrian you are breaking the law. Open carry is perfectly legal anywhere that doesnt post a no-carry sign. I have no CWP.
If you open carry on the bike remember that it is on display and therefore so are you do the right things and make sure your bike is roadworthy registered insured and that you are licensed correctly. Anyway a guy was there with an open carried micro 1911 maybe one of the Mustang clones and he eventually got up and road off on his motorcycle. It states that No person other than a law enforcement officer or conservation officer or any person on the persons own land or land leased by the person may operate or ride on any motorcycle or off-road vehicle with any firearm in the persons possession unless the firearm is completely unloaded and within a carrying case which encloses the entire firearm.
Alabama seems to have a similar law to Pennsylvania. Therefore you can ride a motorcylce while open carrying. I know its legal.
Here it is established case law that a motorcycle is a vehicle for purposes of carrying a firearm so you do need a license to carry while on a motorcycle. The reason is that you dont want to lose your firearm when you go over a bump or land after catching some air. Oddly a horse is not considered a vehicle so you can open carry on.
But the law that allows an unlicensed person to carry a gun in a car says nothing at all about the gun being locked up or not accessible. First IANAL I am not a lawyer I have not heard of a law forbidding open carry at all much less on a motorcycle. Ive seen stranger things happen.
In Oregon you may open carry in a car without a CHL. In your state you may be required to store it under the seat or secured in luggage. I had a question about open carry in ohio.
